Kildare court case struck out for the second time

A court case that was struck out last year, but was re-entered by gardaí, has been struck out for a second time.

Last year, Judge Michéle Finan struck out the case against Dylan Redmond, with an address given as 65 The Glen, Kilnacourt Woods, Portarlington, County Laois, but who is currently remanded in custody for other matters.

On the previous Naas District Court court date, the 30-year-old was accused of possession of a controlled substance for the purpose of sale and supply at Lidl on the Athgarvan Road in Newbridge on November 6, 2019.

However, since the prosecuting garda at the time was unavailable to attend as they had contracted Covid-19, Judge Finan struck out the case.

On the latest date — Thursday, July 20 — presiding Judge Deirdre Gearty was told by gardaí a witness involved in the case was in Westport, but added that they could come down later in the day to assist the court.

Judge Gearty was unhappy with the witness' absence, while defending barrister Donncha Craddock pointed out that the case was previously struck out to her.

When he applied for a strike-out for the re-entered case, Judge Gearty granted it.
