KILDARE: Man found driving dangerously was going 'through a state of psychosis'

Refused to provide a sample

A man who was found to be driving dangerously was  in a state of psychosis, it was stated at Naas District Court.

Before the court was Joe Byrne, 23, whose address was given as Amberly, Tinryland, Carlow.

Sgt Dave Hanrahan told the court the defendant was driving on the M7 at Osberstown, Naas,  on February 28, 2023.

The sergeant said he was driving in heavy traffic at around midday and was flashing his headlights and driving up close to another vehicle to force people to move.

He said he  refused to provide a sample.

Defending solicitor Tim Kennelly said the defendant would not have known what he was doing at the time.

Mr Kennelly said he was going through a state of psychosis.

He also said the defendant appears to be recovered and is off all drugs now.

“He shouldn't have done what he did and at the time he genuinely wasn’t in the right frame of mind.”

Judge Desmond Zaidan commented that the defendant is not helping himself if he has a mental health issue and takes drugs.

He imposed fines of €500 each for dangerous driving and refusing to provide a sample. The defendant was also disqualified from driving for a total of four years.
