Property declared 'unfit  for human habitation' to be acquired by Kildare County Council

Kildare Country Council have issued an acquisition notice for a derelict premises and surround land at 19 Duke Street, Athy, County Kildare.

The land which is described as being in a state of dereliction, contains 0.0713 hectares or thereabouts and while the notice was issued October 3, 2024, the acquisition is still at the proposal stage and the Council have stated:

"Any owner, lessee or occupier (except a tenant for a month or a period less than a month) may on or before Friday, 8 November 2024 submit to the Local Authority an objection to the proposed compulsory acquisition of the derelict site."

The land and house have been deemed "unfit for human habitation and not capable of being rendered fit for human habitation at reasonable expense" according the Council's notice.

Under the The Derelict Sites Act, 1990 (as amended by the Planning and Development Act, 2000) if an objection is made to the proposed compulsory acquisition of a derelict site and the objection remains standing, the derelict site shall not be acquired mandatorily by the Local Authority without the consent of An Bord Pleanála.
