Sgt Grace Rogers told the court of visiting the property on February 8, 2020. She said it was not the defendant’s house though he was present and two of his friends resided there.

She said there were two children there and the defendant was in the sitting room.

Sgt Rogers said the girl was fidgeting and some €160 worth of cannabis herb was found in her pocket.

She said her dad had given it to her.

Sgt Rogers said the defendant was extremely abusive and the girl got very upset.

She added that she took a statement from the defendant in her notebook but he refused to sign it. Barrister Mark Gibbons said the defendant’s mother had died within two days of the incident and the man had not come to garda  attention since then.

On the adjourned date solicitor Jackie McManus said the defendant had not been in trouble for over 20 years.

Ms McManus said he got annoyed because he was intoxicated and he had buried his mother two days previously.

Judge Desmond Zaidan accepted a charitable donation of €1,000 and he imposed a fine of €250 for obstruction. The drugs matter was taken into consideration.
