Kildare County Council (KCC) said that it has no records of any Rights of Way in Carton Demesne.
The revelation was made at a Clane-Maynooth Municipal District meeting held on Friday, February 3.
KCC had made the comments in response to a question by Fianna Fáil Cllr Naoise Ó Cearúil, who asked the council to clarify what the public access and right of way is to Carton Demesne.
In response to Cllr Ó Cearúil’s query, KCC said that it 'does not have records of any Rights of Way in Carton Demesne, aside from the commitments given and Condition 4 of Planning Reference 91/441, as previously advised.'
The council continued: "Public Amenity Rights of Way may be confirmed in the County Development Plan through notification process outlined in the Planning and Development Acts, however Kildare County Council do not have plans to do so.
The judgement given in Walsh & Anor v- Sligo County Council - [2010] IEHC 437, otherwise known as the 'Lissadell Case', is informative regarding the legislative and judicial context of Public Rights of Way.
