Woman prisoner in Mountjoy should be in a rehab centre instead - Kildare judge

Naas Courthouse

The judge hearing a case against a woman in custody said she should be placed in a health setting to deal with her drug addiction.

The woman, aged 32 and with an address at a homeless accommodation centre, appeared before Naas District Court via videolink from the Dóchas Centre, a prison for women within Mountjoy Prison.

She was before the court for assaulting a woman on May 23 last and matters relating to the theft of a laptop and phone, which were damaged.

The court was told that the assault victim was kicked while on the ground.

Defending solicitor Jackie McManus told the court the defendant had her front teeth knocked out with a brick.

Ms McManus also said that while in custody the woman had not been taking drugs and she looks better as a result.

Judge Desmond Zaidan said the woman should be in a healthy setting, which the court has control over, so that she can get proper treatment.

“She is a drug addict. It is sad for her and for the victims of the defendant,” he said.

Garda Shane Lehane told the court that the items stolen could not be subsequently used because of water damage.

Judge Zaidan imposed two consecutive prison terms but on hearing that the victim wished to make a statement he postponed this and said they would be reimposed once the victim has an opportunity to  address the court.
